In a significant legal development, the Calcutta High Court issued directives on February 26 regarding the arrest of Trinamool Congress leader Sheikh Shahjahan, amidst allegations of land grab and sexual assault in Sandeshkhali, West Bengal. The court clarified that there was no stay on his arrest, overturning previous misconceptions surrounding the matter.
A division bench, presided over by Chief Justice T S Sivagnanam and Justice Hiranmay Bhattacharyya, emphasized that the accused should be apprehended by the police authorities without delay. Furthermore, the court mandated the inclusion of Sandeshkhali villagers as parties in the writ petition filed before the court, highlighting the community’s involvement and stake in the legal proceedings.
The court’s clarification sought to dispel any misconceptions arising from previous orders, particularly referencing the February 7 order which stayed the functioning of a Special Investigation Team (SIT) tasked with investigating cases against Sheikh Shahjahan. Importantly, the court underscored that a stay on investigation does not equate to a stay on arrest, emphasizing the necessity of legal action against the accused.
Acknowledging the challenges posed by Sheikh Shahjahan’s absconding status, the bench directed the High Court Registry to publish notices in Bengali and English dailies, informing the public of his involvement in the legal proceedings.
